AUTO ACCIDENTS

When you’ve been hurt in an accident, you need a Nevada auto accident attorney with experience—someone who has helped victims like you for more than 20 years.

The professionals at Maningo Law understand what you’re going through. You have questions about the worth of your insurance claim and how long it will take to get a fair settlement. A car accident lawyer from our law firm will give you straight, simple answers about medical payments coverage, property damage, and lost wages, as well as assist you in completing necessary paperwork. And if your claim requires litigation, we’ll stand by you and fight for you.

Whether you need help getting money for medical bills and car repairs, or you need someone to step in and deal with the insurance company, we’re here to help get you back on your feet. Contact Maningo Law.

After a car accident, you may be confused about whether or not you have a claim for compensation. To be eligible to collect damages, your accident must meet two criteria:

  • The accident was at least partially caused by another party’s negligence.
  • The accident caused you or a family member to suffer physical injuries.

Our Las Vegas and Henderson car accident attorneys can answer any questions you may have about what constitutes negligence and what it means for an injury to be “compensable.” If your attorney determines that your accident meets both of these criteria, we will immediately begin building your claim.

Once the insurance company is notified of your accident, representatives from either your insurance or the at-fault party’s insurance company may contact you. It’s best if you avoid speaking with them. Innocent comments can be manipulated to make it look like the accident was your fault or used to claim that your injuries aren’t severe. They may also try to pressure you into quickly signing a settlement worth far less than you actually deserve.

An experienced Nevada auto accident attorney will take into account your current and future medical bills, lost wages, and other expenses, so you get the compensation you need to cover the true costs of your accident. We’re used to dealing with insurance company tactics, so when the insurance company calls, hang up and contact us instead. We’ll help you figure out whether or not a settlement offer is fair, and we’ll talk to the insurance company for you.

If you have questions about your car accident, we have answers. Contact Maningo Law to get answers to questions about car accident claims.

No matter what caused your auto accident, your injuries are your biggest concern. As Las Vegas auto accident attorneys, some of the most common injuries our clients suffer in highway accidents include:

  • Broken bones
  • Cuts and lacerations
  • Head, neck, and spinal injuries
  • Internal bleeding and organ damage

If you’re the victim of an auto accident, don’t try to take on the insurance company alone. You have rights that protect your best interests, and you may be entitled to more money than the insurance company wants to admit. But you may not know unless you contact Maningo Law.

And when push comes to shove, you want an experienced trial attorney in your corner. While we make every effort to settle your claim quickly and effectively for you- sometimes it is necessary to go to trial. We have the litigation experience and the resources to win. And when it comes to your life … winning matters.

PREMISES LIABILITY AND SLIP AND FALL

When you’ve been hurt on another person’s property, it can be unclear who is responsible for the injuries you’ve suffered and who should compensate you.

At Maningo Law, we know you have many questions after an accident, and our Las Vegas slip and fall lawyers are here to answer them for you. We’ve been helping injury victims in Las Vegas, Nevada, since 2002 – and we have the knowledge and experience to help you get results.

According to the National Safety Council, slip and fall accidents are the single largest cause of emergency room visits. When it comes to slip and fall accidents, we must prove the owner of the property was negligent. In order to build a strong case, we must show that the following occurred:

  • The condition of the property was dangerous
  • The owner knew or should have known, about the property’s condition
  • The owner had a reasonable amount of time to fix the condition of the property

Our Las Vegas slip and fall lawyers know that proving negligence can be difficult for slip and fall accidents, but we also know that we have the knowledge and resources to help. With our dedicated and experienced team, and an office situated in downtown Las Vegas, we have what it takes to get you the compensation you deserve.

If you were injured in a slip and fall accident or any other premises liability related injury, the Nevada slip and fall lawyers at Maningo Law want to protect your rights. Contact Maningo Law.

CASINO INJURIES AND TOURIST ACCIDENTS

Hotel accidents can involve everything from slip, trip and falls, assaults and batteries, bed bugs, to foodborne illness. Maningo Law represents clients in hotel related claims. Accidents can involve every department including the valet, casino, show venues, restaurants, walkways, and the hotel rooms. Criminal activity is often a problem that no hotel personnel can necessarily predict, however, certain events may be repetitive and become not only foreseeable but create liability for the hotel; this is becoming more frequent in the cases for negligent security.

Video, Camera, and Digital Tape Recording-

Cameras link the casino to the “eye in the sky” as a protection for the casino against gaming cheats. In addition, it protects the casino in the event of a crime whether it be a robbery or other attack as it records events that occur throughout the premises. Many victims believe their accident must have been recorded due to the multitude of cameras. This is not always the case. Hotels have a duty to protect and preserve evidence. See the landmark case of Fire Ins. Exchange v. Zenith Radio Corp., 747 P.2d 911, 914 (Nev. 1987). This case was the beginning of a set of cases that set up consequences for the destruction of evidence. Thus, the hotels and casinos must preserve the video reports that contain accidents, or risk that their case is dismissed, or an adverse jury instruction instructing the jury that the missing item must be inferred to benefit the victim.

Much of the accident facts are preserved in the incident report which is usually drafted and assembled by the hotel security. These items are typically not disclosed to the victim and are held internally by the casino. A lawsuit must be filed to get these documents. Maningo Law can help.

Payment of Medical Fees – Hotel Medical Facilities-

The payment of medical expenses is sometimes promised by the hotelier after an accident. When an acute injury occurs, victims are often rushed to the in-house medical clinic that is owned and run by the hotel. These charges are usually taken on by the hotel for obvious reasons. Often, when a victim returns home they are faced with medical expenses they simply cannot afford. Health insurance must pay for an accident injury; however, many Americans do not have the luxury of such coverage.

Negotiations with Risk Management Department-

Injured persons who wish to settle their own claim run many risks. Often, the victim is ignored once they return home. For those fortunate to receive an offer, it is usually followed by a “release of claims” which permanently and forever releases the claim. Signing such a release should be reviewed by a legal professional. It is not uncommon to receive false promises regarding the claim. “Medical expenses will be taken care of.” Then, the calls are never returned, and no proof exists of the promise. Risk management departments are also governed like insurance companies by the Nevada Fair Claims Practices act, as well as numerous insurance regulations. The regulations concerned with here are the provisions that deal with handling claims. False promises are illegal. Moreover, any suggestion for you to not seek an attorney is also illegal. You should have a law firm on your side. Contact Maningo Law.

VICTIMS OF CRIME

A crime may deprive an innocent victim of health, well-being or even life itself. A victim’s road to recovery may be a long and challenging one. Crime victims suffer from physical injuries and mental traumas that may take years to overcome. Victims of violent crimes need to know their legal options. One such option is to pursue an inadequate or negligent security claim against the property owner as well as a claim against all the responsible parties in order to recover compensation in the form of money damages. It is true that no amount of money can ever fully compensate a person who has been shot, stabbed, sexually or physically assaulted, raped, kidnapped, or abducted. However, financial compensation can pay the victim’s medical bills, lost wages, and pain and suffering as a result of the crime. Compensation is essential as emotional trauma, post-traumatic stress disorders, other mental injuries and physical deformities may prevent the victim of a violent crime from working, obtaining future employment or keeping a job in the future.

At Maningo Law, our attorneys are highly skilled at identifying which parties may be liable for the injuries the crime victim has suffered. Our firm is fully equipped to pursue claims against all the responsible parties, including third parties whose negligence may have played a role in the crime. For example, we have pursued claims against the owners of the property where the crime occurred for their failure to provide proper security.

When a crime occurs, victims are usually concerned with seeing the perpetrator of the crime get punished. The criminal court system is designed to ensure those who commit violent crimes pay for their conduct by imprisonment, fines, and penalties. Another concern a crime victim has is mental and physical recovery. Maningo Law helps victims and their family members to move forward and start the path to recovery as soon as possible. Seeking justice through a civil claim and recovering money damages brings a sense of closure and justice. At Maningo Law, we help victims and those who have suffered any physical or emotional injury get the maximum possible compensation available under Nevada law. Please call our dedicated, experienced Las Vegas civil trial attorneys at Maningo Law to discuss your case confidentially.

We handle all types of crime victim cases in Las Vegas and throughout Nevada.

There are, on average, more than 20,000 violent crimes in the state of Nevada each year. When 2016 arrived, the murder rate rose by 12 additional homicides over the previous year so far, and the number of rape cases also rose. These statistics have not decreased.

Victims of crimes deserve justice. In most cases, those who experience assault, hit and run accidents, domestic violence, child abuse, homicide, kidnapping and certain other crimes, can be compensated if they have a good crime victim lawyer. It is extremely important to understand that there may be a claim brought if the victim was injured in any type of business property or even residential property. For example, we will pursue a large claim for negligent security or inadequate security for those victims injured on a business property such as parking lot, mall, hotel, motel, apartment complex, strip mall, and the like.

When victims of crimes have been seriously injured, they may feel helpless. It is hard enough for people to deal with their physical symptoms and recovery, let alone the financial difficulties that are often associated with injuries arising from the crime. If you have been injured as the result of a crime, the last thing you or your family should have to worry about is your financial security. At Maningo Law, we believe that our clients should be allowed to focus on recovering without having to worry about their future financial well-being. We are skilled Las Vegas crime victim lawyers who will aggressively fight for the maximum recovery of damages for our clients’ serious injuries.

TBI/SPINAL CORD INJURY

Every year in the United States, approximately 1.7 million people suffer a traumatic brain injury (TBI) and between four and five million people suffer spinal cord injuries. The Centers for Disease Control reports that TBI is a contributing factor in one-third of all injury-related deaths in the United States and contributes to a significant number of permanent disability cases. An estimated 400,000 people live with the continuing effects of spinal cord injuries. While these numbers are staggering, what is most disturbing is that these injuries are often caused by the fault of others. The top-rated medical malpractice legal team at Maningo Law is dedicated to securing compensation for victims of brain and spine injuries to help you maximize the enjoyment of life in the aftermath of a traumatic accident.

What is a traumatic brain injury or TBI?

Traumatic brain injuries, known as TBIs, are the result of a direct blow to the head, a bump, or a penetrating head injury that interferes with normal brain function. In a TBI, the force of the trauma is significant enough to break through the hard skull and damage the soft tissue of the brain or to cause the brain to move within the skull.

Symptoms of a TBI may present immediately after the event, while other signs may not appear for days or weeks afterward. Physical and psychological effects of TBI are wide-ranging and a medical diagnosis is necessary to determine whether you have suffered a TBI. Car accidents are the cause of approximately 50-70 percent of all TBI. Other causes of TBI include sports-related accidents, slip and falls, and violence.

Spinal injuries and spine trauma-

Sustaining an injury to the neck or back may result in serious damage to the spinal cord. The spinal cord is the bundle of nerves and tissue that is enclosed in the spine and operates as the central carrier of signals throughout the body, connecting nearly all parts of the body to the brain. An injury to the spinal cord may include a bruise – or contusion – which may cause the temporary loss of some function below the site of injury. Injuries may also result in a partial or complete tear, the latter of which causes a total and permanent loss of movement and sensation below the site of injury.

Spinal injuries can be life-changing and have a profound effect on the lives of both the victim and their families. Most spinal injuries are caused by the fault of others, such as vehicular accidents, slip and falls, birth injuries, construction site accidents, surgical error, or playground accidents.

At Maningo Law, our experienced legal team is committed to providing exceptional service in aggressively fighting for those suffering from traumatic brain injury or spine injury. With decades of negotiation, mediation, and litigation experience and a track record of success, our compassionate team is by your side every step of the way. Contact Maningo Law.

MEDICAL NEGLIGENCE AND MALPRACTICE

Medical errors kill and seriously injure thousands of Nevada residents every year. There is an enormous concentration of medical malpractice cases in the Las Vegas, due to the fact that many of the good doctors left the city for liability reasons.

According to the National Institute of Health statistics, almost 320,000 people die every year due to medical errors in the U.S. 3,500 people die each year from unnecessary surgery. 106,000 people are killed annually due to dangerous medication side effects. Between 21,000 and 27,000 malpractice suits are brought against doctors each year. 56% of all medical malpractice cases are filed against surgeons.

Unfortunately, medical mistakes are usually severe and even life-threatening. Injuries such as these are considered “catastrophic” because they can become worse over time, and demand continual medical attention, correction, and observation. Catastrophic injuries often alter the injured patient’s quality of life. A patient who has sustained a catastrophic injury as a result of medical malpractice will usually have an array of physical and/or mental complications that will prevent him/her from returning to work or functioning at his/her normal capacity.

In cases involving medical mistakes, the patient’s physician, surgeon, or medical care provider is usually regarded as the negligent party subject to legal action. When a patient is injured by a medical professional in Nevada, he/she may seek monetary damages from the medical professional. These damages may cover the patient’s medical expenses, lost wages, lost future wages, emotional distress, mental impairment, physical impairment, pain and suffering.

If you think that something was just not right in your care, a medical malpractice lawyer in Nevada can help determine if there is actually a case of malpractice by a health care professional. Unlike a car accident, where the wreckage is clear, medical malpractice can leave the victim wondering if they are imagining things because the health care professional will often try to cover their own tracks and the victim will be inclined to believe them because of their years of education and experience. If you think something is wrong or if you were clearly injured contact a medical malpractice lawyer immediately to find out your next step.

A healthcare professional not taking action where needed, and causing harm to the patient is called medicinal negligence and is malpractice as much as if they took action that caused harm or further injury.

Medical Malpractice May Include:

  • Prescription Errors
  • Problems During or After Surgery
  • Doctor Not Meeting a Minimum Standard of Care
  • Misdiagnoses
  • Failure to Diagnose Cancer
  • Anesthesia Injury or Failure
  • Emergency Room Negligence
  • Birth Injuries
  • Cerebral Palsy
  • Wrongful Death
  • Personal Injury

If you are unsure if you have a case, but feel that something is wrong with you or your family’s care or are left injured, time is important. If you feel you were injured by a medical mistake, contact a Las Vegas medical malpractice lawyer.

Getting the help you deserve is not about revenge. It is about receiving the care you need for the duration of your injury, and compensation for the expensive medical bills associated with the injury or neglect directly caused by a medical professional. For example, in cases where a birth injury harms a baby permanently, the parents will carry the burden of the child’s medical care and costs throughout their life, unless the health care professional that caused the harm is held responsible.

Maningo Law is here to listen to the facts of your case. Absolutely no fees are required upfront, and there is absolutely no fee unless we win. In most cases, our Las Vegas medical malpractice lawyers will not take your case unless it is clear a wrong has been done and you are entitled to compensation due to the breach of the standard of care by the medical professional.

It is impossible for a medical mistake victim to know if their claim has merit and is worth fighting for in court without first consulting an attorney. The best advice will come from a lawyer who is experienced in handling these cases. Contact Maningo Law.

INTENTIONAL TORTS

A tort occurs when one person’s conduct causes harm to another person. As the name implies, an intentional tort occurs when someone acts intentionally (as opposed to negligently) and that action causes harm.

Intentional torts are generally limited to the following acts:

  • assault
  • battery
  • false imprisonment
  • conversion
  • intentional infliction of emotional distress
  • fraud
  • trespass (to land and property)
  • invasion of privacy
  • defamation (slander and libel)

Some courts will also allow an intentional tort case where the defendant intended to commit the act that harmed the plaintiff, but none of the pre-existing categories fit the facts. Because of the greater level of wrongdoing involved, intentional torts are generally punished more severely than other civil wrongs, and the same acts are frequently grounds for a criminal prosecution. For someone who successfully sues and wins an intentional tort case, broad damage awards, including punitive damages, are available.

If you have been injured by an intentional tort, Maningo Law will seek a settlement on your behalf to help make you whole again.

DEFAMATION

Have you been the victim of defamation? Was something written or said about you that caused damage to your reputation? Did the defamation impact your career, leading to job loss or difficulty getting another job? You have the right to seek compensation and justice. Maningo Law can help.

Since 2002, we have built a record of results helping victims of defamation. We represent people in Las Vegas, Henderson, North Las Vegas and throughout Nevada who has had their careers or reputations ruined because of things that have been written or spoken about them.

What is Defamation?

Defamation of character comes in a variety of forms. When it comes in written form, it is referred to as libel. When it comes in spoken form, it is referred to as slander.

In order for something to constitute defamation, it must include a false assertion of fact about a person. Expression of opinion is not defamation of character. For example, if an Internet piece includes a statement of fact that a person was guilty of theft, when in fact the person was not, this could constitute defamation. A speech that makes no reference to facts, but in which the speaker expresses negative opinions about someone else, is not defamation. This can be a fine line, but when the line is crossed, we can take action.

Defamation and False Arrest-

Many defamation cases are associated with claims of false arrest. When a person is accused of a crime, arrested and imprisoned, even if for only a short amount of time, that person could suffer serious damage to their reputation and their career because of the false allegations. Our lawyers have the experience necessary to stand up for people falsely accused of criminal conduct. Call Maningo Law- because we handle most defamation cases on a contingency fee basis, ensuring we believe in you and your case.

DOG BITES AND ANIMAL ATTACKS

It is always the dog owner’s duty to make sure you aren’t bitten or attacked by their dog. The same rule applies to any other animal. To help prevent dog bite injuries, owners have a responsibility to make sure their pets are trained and socialized—this includes keeping their dog’s vaccinations up to date and making sure they are properly restrained at all times.

According to the Centers for Disease Control and Prevention, more than 1 in 5 people who suffer dog bite injuries require medical treatment. At Maningo Law, we are committed to protecting your rights when you’ve been the victim of a dog bite or animal attack incident. With nearly 20 years of experience, our Nevada dog bite and animal attack lawyers have both the resources and knowledge to help you get the compensation you need. Call Maningo Law.

There are a number of reasons why animals attack people—fear, dominance, territory—but determining why someone is attacked isn’t as important as determining what should have been done to prevent the attack. With our experienced legal staff, we are able to thoroughly investigate your incident and make sure all the details of your case are covered. Our Las Vegas lawyer team has helped other dog bite and animal attack injury victims get the money they need to cover their injury-related expenses, and we want to help you too.
