Conspiracy

A conspiracy in the State of Nevada occurs when two or more people reach an agreement to commit a crime. A conspiracy charge is a separate offense. This means an individual can be charged with conspiracy for agreeing to commit a crime AND charged with committing the crime as well.

The key for the prosecution in establishing a conspiracy charge is a showing that two or more parties reached an understanding about committing a crime. It does not have to be an explicit agreement – just an understanding.

Defending a conspiracy charge can be complex for a number of reasons. First and foremost, it can give rise to issues related to how and when the conspiracy began. Additionally, defense counsel must deal with the admission of hearsay statements may be co-conspirators against others involved in the conspiracy.
